Description
The EU aims to provide an understanding—without a legal perspective—of the coastal areas included in the “public maritime domain,” as well as other coastal and offshore maritime zones, and to illustrate which legal regimes apply to these areas: ownership of these areas, rules governing their use, and rules for their development. This encompasses the fields of the law of the sea, coastal law, urban planning, and maritime environmental law.
Objectives
The EU provides an overview of the legal instruments governing the occupation and use of public maritime and riverine areas, and helps readers understand the rules governing their use and exploitation. It discusses certain urban planning regulations designed to govern construction in coastal zones, as well as environmental laws pertaining to coastal zones and waterfronts. It discusses certain regimes governing the exploitation of resources (e.g., fisheries, aquaculture production) and the protection of natural and artificial environments along the coast (obligations arising from Integrated Coastal Zone Management (ICZM), the emerging issue of respecting carrying capacity, etc.). It provides insight into the instruments designed to identify and prevent risks related to the sea. The course is taught within the context of French law, supplemented by aspects of comparative law to examine how other countries address these issues.
